The new 2022 Building Codes
has created a new special inspection: “Tenant Protection Plan Compliance”.This special inspection is required when alteration, partial demolition or construction operations are performed at occupied multiple dwellings with the following exceptions:
A three-family home;
The interior of a single dwelling unit of an occupied multiple dwelling with no disruption to the essential services of other units, where such dwelling units is owner occupied.For a dwelling unit within a property that is owned by a condominium or held by a shareholder of a cooperative corporation under proprietary lease, the unit must be occupied by the owners of record for
such unit; or
The interior of a single dwelling unit of an occupied multiple dwelling three stories or less in height.
This special inspection must be performed by the special inspector as a physical site inspection throughout the duration of the project.The site inspection must be done periodically at A MINIMUM OF ONCE PER WEEK.The special inspector is to verify and indicate that the alteration or construction operation is being performed in accordance with the Tenant Protection Plan.
The Special Inspector is to keep a written
record and maintain a log that must be retained and readily available on the job site and at the office of the Special Inspector. The log must be available for use and review at all reasonable times, until the work subject to the special inspection is complete.
NYEA is not offering these services currently until further
research or information is obtained from the Department of Buildings to fully understand the requirements of this TR1 special inspection.
